Welcome to Color & Grow Learning Press. These Terms of Service (“Terms”) govern your access to and use of the Color & Grow Learning Press website, digital products, educational materials, downloadable resources, and related content (collectively, the “Site” and “Services”).

By accessing the Site, purchasing or downloading a digital product, or otherwise using our Services, you agree to these Terms. If you do not agree, please do not use the Site or Services.

1. About Color & Grow Learning Press

Color & Grow Learning Press (“Color & Grow,” “we,” “us,” or “our”) creates and publishes books, educational materials, and informational resources related to writing, creating, and self-publishing books.

Certain products featured on this Site may be sold and fulfilled by third parties, including Amazon. Digital products may be sold and delivered through Fourthwall or other service providers.

Purchases made through a third-party platform are also subject to that platform's applicable terms, policies, and procedures.

2. Educational Purposes Only

Our publishing guides, articles, templates, checklists, examples, and other resources are provided for general educational and informational purposes only.

We share processes, tools, experiences, and strategies that may help simplify the process of creating and self-publishing a book. However, our materials are not legal, tax, financial, accounting, publishing, intellectual-property, or other professional advice.

You are responsible for evaluating whether any information, tool, platform, content, or strategy is appropriate for your particular project and circumstances.

When appropriate, you should consult a qualified professional regarding your specific situation.

3. No Guarantee of Publishing Approval, Sales, Income, or Results

We believe creating and self-publishing a book can be more approachable than many people realize. However, we do not guarantee any particular result from using our materials.

We do not guarantee that:

• Amazon KDP or another publishing platform will approve or continue to distribute your book;
• your book will meet any platform's current requirements;
• your book will receive reviews, rankings, visibility, or sales;
• you will earn any particular amount of revenue or profit;
• a particular tool, strategy, workflow, prompt, template, or publishing method will produce a particular result; or
• information about third-party platforms will remain unchanged.

Publishing platforms, technologies, laws, costs, and policies change. You are responsible for reviewing and complying with the current requirements of any third-party service you use.

4. Amazon KDP and Other Third-Party Platforms

Color & Grow Learning Press is not affiliated with, endorsed by, sponsored by, or officially associated with Amazon, Kindle Direct Publishing (“KDP”), Canva, OpenAI, or any other third-party company or platform referenced in our educational materials, unless expressly stated otherwise.

All third-party names, trademarks, and service marks belong to their respective owners.

Our materials may explain our experience using third-party tools and services, but the applicable platform's current rules and policies control.

For example, Amazon currently distinguishes between AI-generated and AI-assisted content and requires disclosure of AI-generated text, images, or translations to KDP. Those requirements may change.

5. Artificial Intelligence and Other Tools

Some Color & Grow materials may explain ways artificial intelligence and other technology can assist with brainstorming, editing, research, organization, illustration workflows, formatting, or other aspects of book creation.

AI-generated output may contain errors, inaccuracies, similarities to existing works, or material that is unsuitable for publication.

You are solely responsible for reviewing, editing, fact-checking, and determining whether anything you create or publish is accurate, lawful, original, appropriate, and compliant with the requirements of the platform on which you publish it.

Nothing in our materials represents that the use of an AI tool automatically gives you copyright or other intellectual-property rights in its output.

You are also responsible for making any disclosures required by Amazon KDP or another platform regarding your use of AI-generated content.

6. Intellectual Property and Originality

You are responsible for ensuring that anything you create or publish does not infringe another person's copyright, trademark, right of publicity, privacy rights, or other intellectual-property or proprietary rights.

Our guides do not grant permission to use copyrighted characters, artwork, photographs, books, recipes, trademarks, brands, celebrity likenesses, or other protected material belonging to someone else.

Examples provided by Color & Grow are illustrative only and should not be interpreted as legal clearance to reproduce similar third-party material.

7. Color & Grow Intellectual Property

Unless otherwise stated, the Site and its original content—including our guides, written materials, worksheets, checklists, templates, graphics, branding, illustrations, downloads, and other resources—are owned by or licensed to Color & Grow Learning Press and are protected by applicable intellectual-property laws.

When you purchase a digital guide or download a resource, you receive a limited, personal, non-exclusive, non-transferable license to use it for your own personal book-creation or publishing projects.

Unless we expressly give you written permission, you may not:

• resell or redistribute our guides or downloads;
• upload them to file-sharing sites or shared resource libraries;
• reproduce or republish substantial portions of them;
• sell, license, sublicense, or give copies to others;
• use our materials to create a substantially similar guide, course, template, or other competing educational product; or
• remove copyright, trademark, or proprietary notices.

You may use what you learn from our materials to create, publish, and commercially sell your own original books. Your finished book remains yours.

8. Digital Products

Digital products are delivered electronically.

Because digital products may become accessible immediately after purchase, returns, cancellations, and refunds may be limited once access or downloading begins, except where otherwise required by applicable law or provided by Fourthwall's applicable policies.

Any refund, cancellation, withdrawal, or consumer-rights process administered by Fourthwall will be governed by Fourthwall's applicable terms and policies. Nothing in these Terms limits rights that cannot legally be waived.

Fourthwall specifically provides for statutory consumer rights where applicable, including certain EU/EEA/UK digital-product requirements, so I would not put a blanket “ALL DIGITAL SALES ARE FINAL UNDER ALL CIRCUMSTANCES” provision here.

9. Amazon and Affiliate Links

Some links on this Site may be affiliate links. This means Color & Grow Learning Press may receive a commission if you make a qualifying purchase through the link, at no additional cost to you.

As an Amazon Associate, Color & Grow Learning Press earns from qualifying purchases.

Affiliate relationships do not change the price you pay.

We aim to recommend or feature products because they are relevant to our content, regardless of whether an affiliate relationship exists.

Important: keep the Amazon Associate sentence you already added to the footer, but also put a clear disclosure near affiliate recommendations where appropriate. The FTC says disclosures should be clear and conspicuous and generally closer to the recommendation/link is better.

10. Books Sold Through Amazon

Physical and digital books linked from this Site may be purchased through Amazon or another third-party retailer.

Those purchases are transactions with the applicable retailer and are governed by that retailer's terms, shipping policies, return policies, and customer-service procedures.

Color & Grow does not control Amazon's pricing, availability, shipping, delivery, returns, account policies, or other retail operations.

11. User Responsibility

By using our Services, you agree that you are responsible for:

• your own creative and publishing decisions;
• verifying factual information before publication;
• editing and proofreading your work;
• obtaining appropriate permissions and licenses;
• reviewing current publishing-platform rules;
• complying with applicable laws and regulations;
• properly disclosing AI-generated material when required;
• determining whether you have sufficient rights to publish your content; and
• maintaining appropriate backups of your work.

12. No Warranties

To the fullest extent permitted by law, the Site, Services, and materials are provided “as is” and “as available,” without warranties of any kind, express or implied.

We do not warrant that our materials will be error-free, complete, continuously available, or suitable for every project, or that third-party tools, platforms, links, or services will remain available or function as described.

Nothing in this section excludes warranties or rights that cannot lawfully be excluded.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Color & Grow Learning Press and its owners, affiliates, representatives, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, business opportunities, publishing opportunities, or other losses arising from or related to your use of the Site, Services, or educational materials.

To the fullest extent permitted by law, Color & Grow Learning Press's aggregate liability arising from a purchased digital product will not exceed the amount you paid to Color & Grow for the product giving rise to the claim.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

14. External Links and Services

The Site may link to websites, products, software, or services operated by third parties.

We do not control those third parties and are not responsible for their content, availability, security, privacy practices, pricing, policies, actions, or services.

A link or reference does not necessarily constitute an endorsement.

15. Prohibited Use

You may not use the Site or Services to:

• violate applicable law;
• infringe another person's intellectual-property or other legal rights;
• distribute malware or harmful code;
• attempt unauthorized access to the Site or related systems;
• scrape, systematically copy, or commercially exploit our proprietary content;

• use our Site or materials in a manner that interferes with their operation or another person's lawful use.

Nothing in these Terms deprives a consumer of mandatory rights available under applicable law.

20. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

21. Entire Agreement

These Terms, together with our Privacy Policy and any other policies expressly incorporated by reference, constitute the agreement between you and Color & Grow Learning Press concerning your use of the Site and Services, subject to any additional terms applicable to purchases processed through Fourthwall or another third-party platform.
